(a) Service Fees: CruiseClouds.com may charge non-refundable service fees for booking, modifying reservations, cancellations, name changes, or other services we provide on your behalf. The specific amount of any service fee will be disclosed at the time of booking or as otherwise communicated to you in writing.
(b) Payment for Fares and Charges: You are responsible for all fares, charges, fees, taxes, port fees, fuel surcharges, and any other assessments imposed by CruiseClouds.com or any third-party provider. Fares and rates are quoted in USD unless otherwise specified.
(c) User-Initiated Cancellations and Changes: Any requests for cancellations or modifications to your reservation must be submitted in writing or through the booking portal. Cancellations or changes requested after confirmation may incur our service fees and any additional penalties or charges imposed by the cruise line or other Providers. Change requests (including changes to dates, itineraries, or names) are subject to availability, applicable service fees, and fees set by the Provider.
(d) No-Show and Late Cancellations: If you fail to check in by the required time or do not cancel within the specified time-frame, this will be considered a no-show. No-show bookings and cancellations made after the provider’s stated cancellation deadline are non-refundable and subject to both CruiseClouds.com service fees and the cancellation penalties set by the Provider.
(e) Provider-Imposed Cancellation Policies: Cancellations and refunds are subject to the specific cancellation and refund policies of the cruise line, airline, hotel, or other Provider. These policies may include escalating fees based on how close to the departure date the cancellation occurs, and these fees may be higher than our service fees. CruiseClouds.com acts as your agent in processing refund requests, but all Provider policies will apply.
(f) Force Majeure and Exceptional Circumstances: In cases of force majeure (e.g., weather disruptions, mechanical issues, natural disasters, health emergencies, government actions, or civil unrest) that lead to changes in itineraries, cruise cancellations, or port closures, CruiseClouds.com will make reasonable efforts to assist with rebooking or refund requests. However, we are not liable for any decisions made by Providers regarding refunds or alternative arrangements.
(g) Refund Processing: Refunds, if applicable, will be processed according to the policies of the Provider and the payment card issuer. Depending on the Provider’s and financial institution's procedures, it may take up to 90 days for refunds to be reflected in your account. CruiseClouds.com is not responsible for delays or errors in the refund process caused by Providers or financial institutions.
(h) Third-Party Fees and Penalties: You remain responsible for any fees charged by airlines, hotels, cruise lines, car rental companies, or other Providers for services such as airfare cancellations, hotel no-show penalties, or shore excursion cancellations. These fees are separate from CruiseClouds.com service fees and are non-refundable by us.
(i) Non-Refundable and Guaranteed Fares: Certain promotional fares, guarantee fares, or “best-available” rates may be non-refundable or subject to the discretion of the Provider. If you book a non-refundable fare, you will not be able to cancel, change, or receive a refund unless required by law or the Provider's policy.
(j) Travel Credits and Vouchers: If a Provider offers travel credits, vouchers, or future cruise credits instead of a cash refund, such credits are subject to the Provider’s terms and expiration dates. CruiseClouds.com does not extend or modify the validity of any credits or vouchers issued by Providers.
(k) Travel Insurance Recommendation: We highly recommend purchasing comprehensive travel insurance that covers trip cancellations, interruptions, and non-refundable costs, including service fees, fares, and any other charges. This will help protect your investment in the event of a cancellation by you or a Provider.
The CruiseClouds.com website may include links to third-party Provider websites for your convenience. These external sites are not controlled, endorsed, or monitored by us. (b) Right to Correct: If a pricing or typographical error is found—whether related to fares, promotional offers, or product descriptions—CruiseClouds.com and its Providers reserve the right to correct the error, even after a booking has been confirmed.
(c) Notifications: If your confirmed booking contains a significant pricing discrepancy, we will notify you via email or phone using the contact details you provided. You will be offered the option to either reconfirm your booking at the correct price, cancel your booking without penalty, or receive a full refund of any amounts paid.
(d) Cancellation Option: If you do not respond to our price correction notification within 48 hours, CruiseClouds.com reserves the right to cancel your booking and issue a full refund, including service fees and taxes.
(e) No Liability for Errors: To the fullest extent permitted by law, CruiseClouds.com and its Providers will not be liable for any damages, whether direct, indirect, incidental, or consequential, resulting from pricing or typographical errors, including but not limited to price differences or failures to secure reservations at the originally displayed rate.
(f) Promotional and Guarantee Rates: Certain promotional or guaranteed rates may be subject to additional terms and conditions. If any such rates are displayed incorrectly, we will correct them according to the procedures outlined above.
(g) Customer Verification: We may request additional verification of booking details or identity before processing any corrected pricing or issuing refunds, in order to protect the integrity of the transaction.
(a) Currency Conversion: We source exchange rates from reputable financial data providers. The rates shown on our website are for reference only and may differ from the rates applied by payment processors or Providers when your payment is processed.
(b) Fluctuation Risk: Currency markets fluctuate, and you bear the risk of any difference between the exchange rate shown on the Site and the actual rate applied when the payment is settled.
(c) Transaction Taxes: CruiseClouds.com may collect and remit taxes such as sales, use, occupancy, value-added, excise, or other transaction taxes on behalf of Providers. The amount of tax will depend on the service location, the Provider's policies, and applicable laws. You agree to pay any such taxes.
(a) No Guarantee; At Our Discretion: All promotions, discounts, coupons, promotional codes, and special offers (collectively, “Promotions”) are offered at the sole discretion of CruiseClouds.com or the applicable Provider. These Promotions do not constitute a guarantee or commitment, and we reserve the right to modify, suspend, or withdraw any Promotion at any time and for any reason, without prior notice or liability.
(b) Eligibility and Qualification: Each Promotion may have eligibility criteria, such as residency, age, profession, past passenger status, or membership. You must provide accurate, complete, and verifiable information to prove eligibility. Failure to meet the criteria may result in the cancellation of the Promotion, with your booking adjusted to the standard rate.
(c) Combinability and Usage Restrictions: Promotions cannot be combined with other offers unless explicitly allowed. Specific terms, such as blackout dates, minimum stay requirements, booking windows, and usage limits, will be communicated at the time of the offer. If multiple incompatible Promotions are attempted, the one with the greatest benefit will take precedence.
(d) Provider Terms and Conditions: Some Promotions are controlled by third-party Providers (e.g., cruise lines, hotels, or tour operators) and are subject to their additional terms, cancellation policies, and fees. CruiseClouds.com is not responsible for any Provider-imposed restrictions, and any changes or cancellations to a Promotion by a Provider are beyond our control.
(e) Verification and Revocation: We reserve the right to audit any booking, verify eligibility, and revoke or request repayment of any Promotion or discount if it was used incorrectly or obtained fraudulently. If a Promotion is found to have been misapplied, we may reverse the discount, charge the difference, or cancel the booking entirely.
(f) No Reliance; Promotional Withdrawals: You acknowledge that all Promotions are non-binding and may be withdrawn at any time, even after confirmation. You should not rely on a Promotion until it has been fully confirmed in writing by CruiseClouds.com, and you accept the risk that it may be modified or canceled.
(g) Disclaimer of Promises: CruiseClouds.com and its Providers do not make any promises or representations regarding future availability or reissuance of Promotions. Any forecasts or examples provided are purely illustrative and not guarantees.
(h) Limitation of Liability: To the maximum extent permitted by law, CruiseClouds.com and its Providers will not be liable for any damages arising from the cancellation, modification, or termination of any Promotion, including but not limited to lost savings, consequential damages, or other economic losses.

For EU consumers, the European Online Dispute Resolution (ODR) platform is available at: https://ec.europa.eu/consumers/odr. UK consumers may also use the UK ODR platform for dispute resolution.
(b) California and Other U.S. Consumers
For U.S. consumers, before initiating arbitration or litigation, you may choose to pursue informal dispute resolution or mediation through the American Arbitration Association (AAA) Consumer Arbitration Program. If the total claim is less than $10,000, you may bring your case in small claims court in your county of residence. All mediation or small-claims actions must be initiated within one (1) year of the dispute arising.
(c) Voluntary Mediation Option
Regardless of your location, you may choose voluntary, binding mediation administered by AAA or another mutually agreed ADR provider. To initiate mediation, contact us at support@CruiseClouds.com with a summary of your dispute. We will respond within 30 days with proposed mediation dates.
(d) Waiver of Class Actions
You and CruiseClouds.com each agree to resolve disputes individually and waive the right to participate in any class, consolidated, or representative claims or arbitrations.
(e) Exceptions
Either party may seek preliminary injunctive relief in a court of competent jurisdiction to protect intellectual property, trade secrets, or other proprietary rights.
(a) Currency Conversion and Fluctuations
All prices displayed on the Site are in U.S. dollars (USD) unless otherwise stated. The exchange rates used for currency conversion are sourced from reliable financial data providers and are provided for informational purposes only. The rate applied by your payment processor or bank at the time of settlement may differ from the displayed rate. You accept responsibility for any differences between the displayed rate and the actual rate charged at the time of payment.
(b) Accepted Payment Methods
We accept major credit and debit cards (Visa, MasterCard, American Express, Discover) and other payment methods indicated during checkout. All payment options are subject to availability and may change without prior notice.
(c) Secure Payment Processing
CruiseClouds.com uses PCI DSS–compliant, TLS-encrypted payment gateways to protect your card data. We do not store full card numbers on our servers. By making a payment, you consent to the collection, use, and transmission of your payment details by our third-party processors, in accordance with their privacy and security policies.
(d) Fraud Prevention
To safeguard against unauthorized transactions, we employ industry-standard fraud detection tools and monitoring systems. You agree that CruiseClouds.com may share transaction data with fraud-prevention vendors and law enforcement authorities as necessary to investigate or prevent fraudulent activities.
(e) Chargebacks and Disputes
If you initiate a chargeback with your card issuer, we may contest the dispute by providing evidence such as your booking details, itinerary, and communications. Excessive or unjustified chargebacks may result in cancellation of your booking and a ban from making future reservations. You agree to cooperate fully with any investigation related to a disputed charge.
(a) Definitions and Separate Contracts
“Group Bookings” refer to reservations for ten (10) or more passengers under a single booking. “Charter Parties” refer to exclusive vessel or space charters for groups under a separate agreement. Both Group Bookings and Charters require a dedicated Group Contract or Charter Party Agreement, which will cover deposits, final payment deadlines, itineraries, space allocations, and other special provisions.
(b) Deposits and Payments
For Group Bookings, an initial non-refundable deposit—typically 20% of the total group fare—must be received within the timeframe specified in the Group Contract. Final payments and passenger names must be submitted at least 90 days before departure, or earlier if specified by the cruise line. For Charters, CruiseClouds.com will facilitate the negotiation of deposit schedules, final payment deadlines, and performance guarantees directly with the charterer under the Charter Party Agreement.
(c) Name Changes and Additions
After the passenger name deadline, changes or substitutions may incur fees and service charges as determined by the Provider. If names or passenger counts change after final payment, additional charges or penalties may apply, and availability cannot be guaranteed.
(d) Cancellation and Attrition
Group cancellations and reductions in the guaranteed passenger count (referred to as "attrition") are subject to the terms of the Group Contract or Charter Party Agreement. These typically include tiered cancellation penalties based on proximity to departure and may involve 100% forfeiture within 60 days of departure. Charters may incur full contract price obligations even if the group size decreases.
(e) Coordinator Responsibilities
A designated Group Coordinator (or Charter Contact) must be appointed in writing. The Coordinator will serve as the primary liaison with CruiseClouds.com and Providers, and is responsible for distributing information, collecting individual payments, and ensuring compliance with all Provider rules.
(f) Special Requests and Amenities
Any group-specific requests, such as private events, dining arrangements, shore excursion coordination, or branding, must be submitted in writing and are subject to Provider approval and may involve additional fees.
(g) Liability and Indemnification
The Group Coordinator and chartering entity assume full responsibility for any claims, liabilities, or damages resulting from the conduct of group members or charter activities. You agree to indemnify CruiseClouds.com and Providers for any losses arising from group or charter operations.
(a) Provider Health Requirements
Cruise lines, airlines, hotels, and other Providers may impose health-screening measures, vaccination requirements, testing protocols, or quarantine rules before boarding, during travel, or upon return. These requirements can change on short notice based on public health guidance or local regulations.
(b) Customer Compliance
You are solely responsible for understanding and complying with all health-related requirements imposed by Providers, ports of call, and government authorities. This includes obtaining and presenting any required negative test results, vaccine certificates, health questionnaires, or medical clearances.
(c) Costs and Risks
You assume all costs—even those occurring after booking—for COVID-19 or other health-related testing, treatment, isolation, quarantine, or repatriation. CruiseClouds.com is not responsible for medical expenses, missed connections, or additional accommodation costs resulting from health-related delays or denials of boarding.
(d) No Liability for Changes
Providers may cancel, postpone, or alter itineraries, shore excursions, or onboard services for health and safety reasons. CruiseClouds.com will assist with rebooking or refund requests, but we disclaim liability for Provider decisions, health-related disruptions, or any associated losses.
(e) Force Majeure
Health emergencies, pandemics, or other public health events are considered force majeure events under Section 22(e), and neither CruiseClouds.com nor Providers will be liable for cancellations, delays, or changes resulting from such events.
(a) Translations
We may provide translated versions of these Terms & Conditions for your convenience. In the event of any conflict or inconsistency between the English version and a translated version, the English version shall govern and control.
(b) Governing Language
These Terms & Conditions, any notices, and all related communications shall be drafted in English. If any translated versions conflict with the English text, the English version shall prevail.
(c) Accuracy of Translations
Translations are provided as a courtesy only; CruiseClouds.com does not warrant the accuracy, completeness, or reliability of any translation. You agree that any dispute arising under these Terms shall be governed by and construed in accordance with the English-language version.

(c) Incident Response Plan
We maintain a formal Incident Response Plan that outlines clear roles, escalation paths, and procedures for detecting, containing, eradicating, and recovering from security incidents. In the event of a confirmed security breach affecting your Personal Information, we will:
(d) Data Backup and Recovery
We perform regular, encrypted backups of critical systems and data and test our recovery procedures at least quarterly to ensure timely restoration of services in the event of data loss or system failure.
(a) Availability Target
CruiseClouds.com strives to offer its Site and core booking Services at a minimum of 99.9% uptime each calendar month, excluding scheduled maintenance and events beyond our reasonable control (Section 22(e), Force Majeure).
(b) Scheduled Maintenance
We may perform planned maintenance during off-peak hours (typically between 12:00 AM and 4:00 AM ET). Maintenance notifications will be published at least 48 hours in advance on our Site and/or via email to affected users.
(c) Support Response Times
Our support team aims to respond to critical issues (Site down, booking failures) within two (2) business hours and to non-critical inquiries (general questions, minor usability issues) within one (1) business day.
(d) Remedies and Limitations
While we use commercially reasonable efforts to meet these targets, they are goals and not guarantees. CruiseClouds.com disclaims any liability for failure to meet the service levels, except as expressly stated. No financial credits, refunds, or other remedies are offered for downtime or service interruptions, other than as specified in Section 10 regarding refunds for canceled travel services.
(e) Exclusions
This commitment does not apply to downtime caused by scheduled maintenance, actions or inactions of third-party Providers, your equipment or network, or events of force majeure.
(a) Reservation of Rights
CruiseClouds.com and its Providers reserve the unqualified right to refuse, suspend, or terminate service to any User or passenger at any time, for any lawful reason, and at our sole discretion, without liability or obligation to provide refunds (except as otherwise required by applicable consumer protection laws).
(b) Abusive Conduct
Abusive, harassing, threatening, or discriminatory language or behavior—whether spoken, written, or transmitted electronically—toward our customer-support staff, chat agents, or other employees will not be tolerated and may result in immediate suspension or termination of service, without refund.
(c) Non-Discrimination
Any refusal, suspension, or termination of service under this section shall be carried out in compliance with all anti-discrimination laws and shall not be based on race, religion, gender, sexual orientation, disability, national origin, age, or any other protected characteristic.
